Mozilla Public License 2.0

1. Definitions

1.1. “Contributor”

This refers to any person or organization that produces, participates in producing, or holds ownership rights over Covered Software.

1.2. “Contributor Version”

This signifies the amalgamation of contributions from others (if any) that are utilized by a Contributor, along with the specific contribution made by that Contributor.

1.3. “Contribution”

This denotes the Covered Software associated with a specific Contributor.

1.4. “Covered Software”

This refers to the Source Code Form that the initial Contributor has annotated with the notice in Exhibit A, the Executable Form derived from this Source Code Form, and any alterations made to this Source Code Form, encompassing partial elements in each instance.

1.5. “Incompatible With Secondary Licenses”

This indicates that the initial Contributor has affixed the notice outlined in Exhibit B to the Covered Software, or that the Covered Software was provided under the conditions of version 1.1 or earlier of the License, excluding the terms of any Secondary License.

1.6. “Executable Form”

This refers to any form of the work aside from its Source Code Form.

1.7. “Larger Work”

This denotes a creation that merges Covered Software with additional material, found in separate files, which does not fall under the category of Covered Software.

1.8. “License”

Means this document.

1.9. “Licensable”

This implies having the authority to provide, to the fullest extent feasible, whether granted initially or later on, all the rights stipulated by this License.

1.10. “Modifications”

Means any of the following:

Any file in Source Code Form that emerges from altering, removing, or modifying the contents of Covered Software; or any new file in Source Code Form that includes any Covered Software.

1.11. “Patent Claims” of a Contributor

This refers to any patent claim(s), encompassing method, process, and apparatus claims, within any patent for which such Contributor holds licensing rights, which would be violated, were it not for the issuance of the License, by the creation, utilization, sale, offer for sale, manufacturing, importation, or transfer of either its Contributions or its Contributor Version.

1.12. “Secondary License”

This signifies either the GNU General Public License, Version 2.0, the GNU Lesser General Public License, Version 2.1, the GNU Affero General Public License, Version 3.0, or subsequent iterations of these licenses.

1.13. “Source Code Form”

This refers to the preferred format of the work for implementing modifications.

1.14. “You” (or “Your”)

This denotes an individual or a legal entity that is exercising rights under this License. For legal entities, “You” encompasses any entity that controls, is controlled by, or is under common control with You. For the purposes of this definition, “control” indicates (a) the authority, whether direct or indirect, to influence the direction or management of such entity, whether through contract or otherwise, or (b) ownership of over fifty percent (50%) of the outstanding shares or beneficial ownership of such entity.

2. License Grants and Conditions

2.1. Grants

Each Contributor hereby provides You with a global, royalty-free, non-exclusive license:

Under the intellectual property rights (excluding patents or trademarks) licensable by the Contributor, You are granted the right to use, reproduce, make available, modify, display, perform, distribute, and otherwise exploit its Contributions, either in their original form, with modifications, or as part of a larger work; and

Under the patent claims of the Contributor, You are granted the right to make, use, sell, offer for sale, have made, import, and otherwise transfer either its Contributions or its Contributor Version.

2.2. Effective Date

The licenses described in Section 2.1 pertaining to any Contribution take effect for each Contribution as of the date when the Contributor initially distributes said Contribution.

2.3. Limitations on Grant Scope

The licenses granted in Section 2 constitute the sole rights provided under this License. No additional rights or licenses are implied by the distribution or licensing of Covered Software under this License. Despite the provision in Section 2.1(b) above, Contributors do not extend any patent license for:

  • Any code that a Contributor has removed from Covered Software.
  •  Infringements caused by: (i) Your or any other third party’s modifications of Covered Software, or (ii) the combination of its Contributions with other software (except as part of its Contributor Version).
  • Patent Claims infringed by Covered Software in the absence of its Contributions.

This License does not confer any rights to the trademarks, service marks, or logos of any Contributor, except as may be necessary to comply with the notice requirements outlined in Section 3.4.

2.4. Subsequent Licenses

No Contributor extends further grants due to your decision to distribute the Covered Software under a later version of this License (refer to Section 10.2) or under the terms of a Secondary License (if allowed according to Section 3.3).

2.5. Representation

Every Contributor affirms that they believe their Contributions are original creations or that they possess adequate rights to grant the permissions to their Contributions as conveyed by this License.

2.6. Fair Use

This License does not aim to restrict any rights you may possess under relevant copyright principles such as fair use, fair dealing, or similar equivalents.

2.7. Conditions
Sections 3.1, 3.2, 3.3, and 3.4 constitute conditions for the licenses granted in Section 2.1.

3. Responsibilities

3.1. Distribution of Source Form

Any distribution of Covered Software in Source Code Form, including any Modifications you create or contribute to, must adhere to the terms of this License. You are obligated to notify recipients that the Source Code Form of the Covered Software is subject to the terms of this License and provide instructions on how they can acquire a copy of this License. You are prohibited from attempting to modify or limit the rights of recipients in the Source Code Form.

3.2. Distribution of Executable Form

If you distribute Covered Software in Executable Form, then:

  •  Such Covered Software must also be accessible in Source Code Form, as outlined in Section 3.1. You are required to inform recipients of the Executable Form how they can obtain a copy of the Source Code Form through reasonable means in a timely manner, at a cost no higher than the distribution expense to the recipient.
  • You have the option to distribute such Executable Form under the terms of this License or sublicense it under different terms. However, the license for the Executable Form must not attempt to restrict or modify the rights of recipients in the Source Code Form under this License.

3.3. Distribution of a Larger Work

You are permitted to develop and distribute a Larger Work under terms of your preference, on the condition that you also adhere to the obligations of this License for the Covered Software. If the Larger Work comprises a combination of Covered Software with a work governed by one or more Secondary Licenses, and the Covered Software is not Incompatible With Secondary Licenses, this License allows you to distribute the Covered Software additionally under the terms of such Secondary License(s). This provision enables the recipient of the Larger Work to further distribute the Covered Software under either this License or the applicable Secondary License(s) as per their choice.

3.4. Notices

You are prohibited from deleting or modifying the content of any license notices (including copyright notices, patent notices, disclaimers of warranty, or limitations of liability) present within the Source Code Form of the Covered Software, except where necessary to correct known factual inaccuracies.

3.5. Application of Additional Terms

You have the option to provide and charge a fee for warranty, support, indemnity, or liability obligations to one or more recipients of Covered Software. However, you can only do so representing yourself, not any Contributor. It is imperative that you explicitly state that any such warranty, support, indemnity, or liability obligation is solely offered by you. Additionally, you agree to indemnify every Contributor for any liability they may incur due to the warranty, support, indemnity, or liability terms you provide. You are also allowed to include additional disclaimers of warranty and limitations of liability specific to any jurisdiction.

4. Inability to Comply Due to Statute or Regulation

If compliance with any terms of this License regarding some or all of the Covered Software is impossible due to statute, judicial order, or regulation, you must: (a) adhere to the terms of this License to the fullest extent feasible, and (b) outline the constraints and the code they impact. This description must be included in a text file accompanying all distributions of the Covered Software under this License. Unless prohibited by statute or regulation, this description must be adequately detailed for an ordinary recipient to comprehend it.

5. Termination

5.1. The rights provided under this License will cease automatically if you fail to adhere to any of its terms. However, if you achieve compliance, then the rights granted under this License from a specific Contributor are restored: (a) provisionally, unless and until that Contributor explicitly and conclusively revokes your grants, and (b) continuously, if that Contributor does not inform you of the non-compliance through reasonable means within 60 days after you have regained compliance. Additionally, your grants from a specific Contributor are continuously restored if that Contributor notifies you of the non-compliance through reasonable means, this being the first instance you’ve received such notice from that Contributor, and you achieve compliance within 30 days after receiving the notice.

5.2. If you commence legal action against any entity by asserting a patent infringement claim (excluding declaratory judgment actions, counter-claims, and cross-claims) alleging that a Contributor Version directly or indirectly infringes any patent, then the rights granted to you by all Contributors for the Covered Software under Section 2.1 of this License will be revoked.

5.3. If termination occurs under Sections 5.1 or 5.2 as mentioned above, all end user license agreements (excluding distributors and resellers) that have been legitimately granted by you or your distributors under this License before termination will remain valid.

6. Disclaimer of Warranty

The Covered Software is provided under this License on an “as is” basis, without any warranty, whether expressed, implied, or statutory, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. You bear the entire risk regarding the quality and performance of the Covered Software. If any Covered Software is found to be defective in any way, you (and not any Contributor) are responsible for any necessary servicing, repair, or correction costs. This disclaimer of warranty is an essential component of this License. No use of any Covered Software is authorized under this License except in accordance with this disclaimer.

7. Limitation of Liability

Under no circumstances and under no legal theory, whether in tort (including negligence), contract, or otherwise, shall any Contributor, or anyone who distributes Covered Software as permitted above, be liable to you for any direct, indirect, special, incidental, or consequential damages of any kind, including, but not limited to, damages for lost profits, loss of goodwill, work stoppage, computer failure or malfunction, or any other commercial damages or losses, even if such party has been advised of the possibility of such damages. This limitation of liability does not apply to liability for death or personal injury resulting from such party’s negligence to the extent applicable law prohibits such limitation. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so this exclusion and limitation may not apply to you.

8. Litigation

Any legal action concerning this License must be filed exclusively in the courts of a jurisdiction where the defendant’s principal place of business is located. Such legal proceedings shall be governed by the laws of that jurisdiction, without considering its conflict-of-law provisions. This section does not impede a party’s right to bring cross-claims or counter-claims.

9. Miscellaneous

This License constitutes the entire agreement regarding its subject matter. If any provision of this License is deemed unenforceable, it shall be revised only to the extent required to render it enforceable. Any law or regulation stipulating that the language of a contract be interpreted against the drafter will not be applied to construe this License against a Contributor.

10. Versions of the License

10.1. New Versions

The Mozilla Foundation acts as the custodian of the license. Except as outlined in Section 10.3, no entity other than the custodian has the authority to alter or release new editions of this License. Each iteration will be assigned a unique version identifier.

10.2. Effect of New Versions

You have the option to distribute the Covered Software according to the version of the License you initially obtained it under, or under any later version published by the license steward.

10.3. Modified Versions

If you develop software that is not subject to this License and wish to formulate a new license for such software, you are permitted to devise and employ an adapted version of this License, provided you rename the license and eliminate any mentions of the name of the license steward (except to indicate that the modified license deviates from this License).

10.4. Distributing Source Code Form that is Incompatible With Secondary Licenses

If you opt to distribute Source Code Form that is Incompatible With Secondary Licenses under the provisions of this version of the License, you must include the notice outlined in Exhibit B of this License.

Exhibit A – Source Code Form License Notice

If it’s neither feasible nor preferable to place the notice within a specific file, you have the option to place it in a location—like a LICENSE file within a pertinent directory—where it’s probable for recipients to search for such a notice.

You may add additional accurate notices of copyright ownership.

Exhibit B – “Incompatible With Secondary Licenses” Notice

This source code form is deemed “Incompatible With Secondary Licenses” as per the specifications defined within the Mozilla Public License, version 2.0.
